Item A critical Legal analysis on Medical Negligence in Bangladesh(Daffodil International University, 2025-02-11) Islam, Md. RakibulMedical negligence is when healthcare professionals fail to do their job properly, causing harm to the patient and violating their right to good health. Medical mistakes or errors are currently a well- known subject of focus and discussion in many advanced countries. As a result, several of these countries have put in place separate laws and courts to make healthcare laws stronger. However, in Bangladesh, there are no specific laws to stop medical mistakes, even though there are some legal rules in different laws that are not clearly written down. Additionally, doctors and healthcare workers need to know and understand the legal effects of their mistakes in providing medical care. They also need to focus on behaving ethically in order to avoid getting caught up in controversial situations and legal cases. Medical practitioners sometimes avoid taking responsibility for their actions because people are not willing to report them or take action against them. Many individuals lack sufficient knowledge about their legal rights when faced with instances of medical negligence. This paper tries to explain medical negligence, the laws about it in Bangladesh and their problems, gather the necessary legal information and suggests ways to prevent violations of healthcare rights.Item A critical review of the road safety laws in Bangladesh(Daffodil International University, 2025-10-26) Akter, AkhiIn Bangladesh, road traffic accidents continue to be one of the most serious public safety issues, taking an estimated 20000 to 25000 lives each year and causing enormous social and financial hardships. This thesis critically analyses Bangladesh’s road safety laws, paying special attention to the Road Transport Act of 2018 and Road Transport Regulations of 2022. The report examines the legislation strengths, limitations and scope. It also finds implementation gaps and places Bangladesh’s strategy in relation to global best practices. The research sheds light on systemic flaws that impede efficient enforcement by combining doctrinal legal analysis, policy document assessment, secondary statistics reporting and primary field work data. The main conclusion include fragmented laws, inadequated instituational coordination between law enforcement, DTCA and BRTA a lack of post-crash response systems and the political clout of transport unions elements like corruption, ignorance and public acceptance of risky activities. Trough the incorporation of user-centric perspective’s on law enforcement and the filing of gaps in comparative analyses, the thesis adds to the body of literature.Item “A Critical Review on the Nature and Manifestation of Violence against the Hindu Minority in Bangladesh: A Legal Study”(Daffodil International University, 2025-05-13) Joy, Mehedi HassanThis abstract provides an overview of the nature and manifestation of violence against the Hindu minority in Bangladesh, shedding light on the historical, socio-political, and cultural factors that contribute to this phenomenon. The paper explores the roots of violence, ranging from communal tensions to political manipulation, and delves into the various forms of violence experienced by the Hindu minority, including physical attacks, property destruction, and cultural persecution. Additionally, it analyzes the impact of such violence on the lives and livelihoods of the affected minority, as well as the broader implications for Bangladesh’s social fabric and international standing. The study combines a comprehensive analysis of existing literature, case studies, and qualitative data to present a multifaceted perspective on this pressing issue. In conclusion, it underscores the urgent need for effective interventions to address violence against the Hindu minority in Bangladesh, fostering a climate of tolerance, inclusivity, and human rights for all its citizens.Item A Critical study on the impact of Dowry system in Bangladesh(Daffodil International University, 2024-09-01) Saon, Md. Mehedi HasanIn Muslim weddings in Bangladesh, dowry and dower play important roles; yet, socio-legal obstacles often make it impossible for women to obtain the dowries that are legally theirs. In this study, Isought to understand the various meanings of dowry, the rationale for the system, and the social issues surrounding dowry. I have some findings and suggestions on how to get rid of it. Laws like the Dowry Prohibition Act of 2018 aim to outlaw the giving, receiving, or demanding of dowries in order to eliminate these traditions. More adjustments might be needed in order to fully safeguard women's rights and end the exploitation of marriage agreements.Item A Research Monograph on Safety Measures under the Bangladesh Labour Act, 2006 and International Labour Organizations Standard: A Comparative Study(Daffodil International University, 2025-11-22) Kamal, OmarBangladesh Labour Act of 2006 has great importance. We are aware of how significantly the industrial sector affects a nation's overall economy. So, the rights to safety of the labour must be ensured. All prosperity in industrial sector is the product of labours. Various international conventions uphold the spirit of this line. International Labour Organization sets the standard of rights regarding safety for the labours. Bangladesh has ratified some of the conventions regarding safety standard of ILO. Bangladesh has implemented some of those standards in the Bangladesh Labour Act. But many important measures have not been implemented in the Bangladesh Labour Act. Those necessary measures must be implemented. The protection of workers’ rights and safetyis of utmost importance to the industrial sector and, consequently, to the country's economy as a whole. This is why the Bangladesh Labour Act of 2006 is so important. Because all wealth in theindustrial sector is a direct result of laborers‟ hard work and dedication, it is imperative to ensure their safety and well-being. This idea is supported by a number of international accords that highlight the importance of strong labour laws and safety regulations. A number of the labour safety conventions established by the International Labour Organization (ILO) have been ratifiedby Bangladesh. Bangladesh’s dedication to upholding international standards for worker safety is demonstrated by this ratification. Some of these requirements are incorporated into the Bangladesh Labour Act, demonstrating an attempt to harmonies domestic legislation with global standards.Item An Analysis of Cybercrime in Bangladesh :Legal Frameworks, Emerging Trends and Challenges(Daffodil International University, 2025-10-11) Emrose, NaimaThis article discourses and evaluates the cybercrimes of Bangladesh. Basically, it is causing harm to individual’s reputation, property, asset, intellectual property, privacy etc. there are many kinds of cybercrimes in our country. Many research were approved on cybercrime but not a singal research work could put effective result to prevent cybercrime. To prevent cybercrime and creating a secure society, policymakers need to make a strong framework for cybercrime and need to adopt new methods. Through this we can make a secure society and secure Bangladesh.Item An Appraisal Juvenile Delinquency in Bangladesh:(Daffodil International University, 2024-09-02) Islam, AyeshaThe beginning of delinquent behavior is not at birth. It is not their choice, but Bangladesh'ssocio-legal environment that leads most young people to become delinquents. Juvenile delinquency has become a major concern in recent years due to an increase in children participating in criminal activities. But criminals, both male and female, are multiplying daily and committing a wide range of crimes, such as robbery, hijacking, carrying weapons and illegal substances, murder, trafficking, smuggling, and fraud. Numerous socioeconomic factors have affected them, such as peer pressure, excessive satellite television viewing, lack of direction, inappropriate internet use, and deprivation. Consequently, the way society is currently set up is destroying children's childhoods and depriving them of their rights. As an illustration, consider family life, education, health, games, care, and defense. For the purpose of protecting and preventing them, children must be given extra consideration, encouraging attention, and a child- friendly attitude. This thesis looks at significant sociolegal factors as well as contemporary trends that contribute to juvenile delinquency in Bangladesh.Item An Evaluation of Legal Safeguards for the Right to Life of Street Children in Bangladesh(Daffodil International University, 2025-10-26) Tasnim, AnannaOne of the most vulnerable and marginalized groups in Bangladesh are street children, who face major risks to their right to life due to abuse, neglect, lack of access to basic services, and legal invisibility. The current legal protections—constitutional, statutory, and international—that are intended to preserve the lives and welfare of Bangladeshi street children are critically assessed in this study. The research maps out both the formal legal protections and significant gaps in implementation using secondary data, such as legal texts like the Children Act, 2013; constitutional provisions (such as Articles 15, 17, etc.); international instruments to which Bangladesh is a party (particularly the UN Convention on the Rights of the Child, or CRC); and reports from NGOs and UN agencies. The study comes to the conclusion that, despite being essential and generally well- designed, legislative protections are insufficient in reality to ensure street children's right to life. Strengthening child-friendly courts, enhancing monitoring and accountability systems, increasing outreach and social services, raising street children's awareness of the law, and specifically including them into child protection programs are some of the recommendations it makes.Item ‘Animal Rearing as A Legal Right: A Socio-Legal Analysis With Special Reference to Bangladesh’(Daffodil International University, 2025-11-23) Haque, Munshi Md MazharulThis study shows us the socio legal view of animal rearing in Bangladesh, analyzing existing laws, norms and policies also it considers the social practices. It evaluates the effectiveness and importance of animal welfare and rearing law in Bangladesh. The research identifies enforcement, gap, low loops and socio economics challenges which affecting in animal rearing. Practicing by international best practices, the study recommends policy reform, education, economic point of view and industrial revolution in urban. After that all consideration we can make a best animal rearing law in Bangladesh.Item Creditors' Winding Up in Bangladesh: A Critical Study on the Legal Framework(Daffodil International University, 2024-08-31) Rahman, RaisurThis study aims to analyze the legal framework for creditors' winding up in Bangladesh, identify the practical challenges faced by creditors during the process, and compare Bangladesh's framework with other jurisdictions. The research employs a qualitative methodology, including a comprehensive review of relevant literature, case studies, and interviews with key stakeholders. The findings suggest that while Bangladesh's insolvency laws provide for creditors' winding up, there are significant practical challenges, such as delays in court procedures, lack of coordination among stakeholders, and inadequate enforcement mechanisms. The study concludes with policy recommendations to improve the creditors' winding up process in Bangladesh.Item Discrimination Against Women: Legal Gaps and the Role of Reform in Promoting Gender Equality"(Daffodil International University, 2025-11-11) Roy, DiponDiscrimination against women is defined as the people who are treated differently simply due to their gender identity or gender expression. Discrimination can present in a variety of ways, such as unbalanced treatment in the workplace, less access to education, less access to health care, and social exclusion. Discrimination reinforces negative stereotypes, impedes social equity, and irrationally impedes growth. Discrimination against women is a complex and multifaceted issue with historical roots. Discrimination is often tied to societal norms that come from historical belief systems around role-based expectations, perceptions of gender-based roles, and perceptions of power imbalances, which are often unconsciously reinforced, and the degree of impact on individuals relates to opportunities and experiences, and overall impact on well-being and health. Addressing discrimination takes an entire society approach, a multi-faceted approach that must address the conceptualization of social norms, with considerations for equitable opportunity and social norms through incentives, laws, etc., ensuring that there are legal protections for all people, irrespective of their gender identity or gender expression.Item Dissertation On Parole and Probation in Bangladesh: Problems and Prospects(Daffodil International University, 2025-05-12) Mezor, Kafi KhanParole and probation serve vital functions in the criminal justice system. They provide alternatives to incarceration and help offenders reintegrate into society. However, administrative inefficiencies weaken their effectiveness in Bangladesh. A lack of legal clarity, limited institutional capacity, and societal stigma further hinder their implementation. This research analyzes the parole and probation framework in Bangladesh. It identifies key challenges and explores potential reforms. The study examines best practices from other jurisdictions. It highlights strategies that Bangladesh can adapt to improve its system. Judicial and correctional institutions play a crucial role in implementing parole and probation. This research evaluates their effectiveness in ensuring fair and proper application. It emphasizes the need for stronger legal provisions and better monitoring systems. Additionally, it calls for more community-based rehabilitation programs. SohaiebDrug misuse and trafficking present serious problems for Bangladesh, affecting its social cohesion, economic growth, and public health, according to my paper, “Drug Regulation in Bangladesh: A Comparative Study of Local Laws and Global Norms,” To solve these issues and protect the welfare of the country, it is imperative that effective drug control mechanisms be put in place. A comparative study of Bangladesh's domestic drug control laws and international drug control norms is the goal of this thesis. The study will pinpoint the difficulties Bangladesh faces in putting international norms into practice and investigate how to get beyond these obstacles and improve the efficacy of drug control. In addition to highlighting important shortcomings in institutional capacity, policy coherence, and enforcement, the study also identifies areas in which Bangladesh has made impressive strides. It also looks at how international cooperation and adherence might improve the nation's drug control tactics. The results highlight how crucial it is to align domestic legislation with international standards in order to establish a more effective, strong, and human rights-compliant drug control system. However, the Constitution of Bangladesh, through its Fundamental Principles of State Policy, expresses a clear intent to eliminate gambling. In addition to the Constitution, several secondary laws are in place to regulate and penalize gambling activities. This study aims to assess the current state of gambling in Bangladesh, examine the existing legal framework, evaluate the effectiveness and limitations of these laws, and offer recommendations for addressing key issues. The research has identified several legal challenges in regulating gambling in the country. It concludes by recommending a coordinated response involving legislative reform, executive enforcement, and judicial oversight to better control and prevent this unlawful practice.Item Human Trafficking Traps and Relevant Laws In Bangladesh : A Legal Analysis(Daffodil International University, 2025-05-17) Shabnam, Farzana AahmedHuman trafficking is a major global concern, and Bangladesh plays a key role as a source, transit, and destination country. Common forms of trafficking in the country include sexual exploitation, forced prostitution, domestic servitude, and bonded labor, disproportionately affecting vulnerable groups, especially women and children. This research examines the various human trafficking traps and evaluates the effectiveness of existing legal frameworks in Bangladesh. By analyzing anti- trafficking laws, enforcement mechanisms, and the role of NGOs, this study highlights critical gaps in policy and implementation. It also emphasizes the importance of multilateral cooperation, public awareness, and education in combating this crime. The findings propose actionable recommendations to enhance legal provisions and collaborative efforts between governmental and non-governmental organizations, aiming to mitigate the growing threat of human trafficking and ensure justice for victims.Item International Human Trafficking from Bangladesh(Daffodil International University, 2025-04-28) Roy, ShathiIn Bangladesh, human trafficking persists as a serious violation of human rights, in spite of extensive legal frameworks and global accords designed to eradicate it. This paper examines the legal framework in Bangladesh for the fight against human trafficking, identifies important implementation issues, and makes recommendations for improvements. Resource constraints, judicial and law enforcement corruption, a lack of victim support, poor coordination, sluggish court proceedings, and neglected socioeconomic issues are the key challenges. The report makes several recommendations, including strengthening the capacities of the legal system and law enforcement, promoting international collaboration, bettering victim services, better coordination, and changing laws and policies. Bangladesh can enhance its anti- trafficking endeavors, safeguard its populace, and preserve their entitlements by implementing these approaches. This report emphasizes the necessity for a coordinated and all-encompassing strategy to end human trafficking, providing insightful information for legislators, law enforcement, non-governmental organizations, and other stakeholders.Item Juvenile Delinquency and the Role of Digital Evidence in Bangladesh: Challenges, Legal Framework, and Policy Implications(Daffodil International University, 2025-11-26) Ayoshe, Bilkis AkterThis thesis examines the phenomenon of juvenile delinquency in Bangladesh with a particular focus on the role and application of digital evidence in legal proceedings. It investigates how the legal system addresses crimes committed by juveniles, the challenges associated with collecting, preserving, and presenting digital evidence, and the implications for justice and rehabilitation. The study employs a mixed-methods approach, combining qualitative interviews with legal experts, law enforcement officials, and stakeholders, along withquantitative analysis of relevant case data. Key findings reveal gaps in the current legal framework, limited technological resources, and insufficient training for handling digital evidence in cases involving juveniles. These challenges affect both the efficiency of investigations and the protection of juveniles’ rights under existing laws. Based on the analysis, the thesis offers recommendations to strengthen the legal and procedural mechanisms, improve digital forensic capacity, and promote collaboration among law enforcement agencies, courts, and policymakers. The study aims to contribute to the ongoing discourse on juvenile justice reform in Bangladesh and the effective integration of digital evidence into the judicial process.Item Land Law, Land Disputes and Land Administration in Bangladesh - A Critical Study(Daffodil International University, 2025-07-22) Srabonti, SrabontiLand governance in Bangladesh is challenged by outdated legal frameworks, administrative inefficiencies, land grabbing, gender inequality, and widespread disputes over ownership and boundaries. This research critically investigates the complex interplay between historical land laws, contemporary administrative structures, and the socio-political influences that hinderequitable land distribution and rights. Employing a qualitative approach that combines legal document analysis and interviews with stakeholders, the study explores how poor record-keeping, manual registration systems, corruption, and the exclusion of vulnerable groups affect land justice. It evaluates global strategies and technological reforms, including digital land management and alternative dispute resolution mechanisms, to propose a holistic and transparent system for modern land governance. The research concludes with recommendations for digitization, legal reforms,public awareness, and the institutional strengthening necessary to ensure secure land tenure, especially for marginalized populations. The findings aim to support policymakers andpractitioners in transforming Bangladesh’s land governance into a just, inclusive, and sustainable framework.
