Abstract

Conservation 0f environment is most important issue all over the world. Due to climate change the existence of life on earth is in threat. The Main reason of climate change is continuous environment pollution. Environmentalists of the world have tried to focus the attention of world leaders on this and other pressing environmental matters for a long time. The Stockholm Conference on Human Environment in 1972 was one of the first internationally collaborative efforts. In Bangladesh perspective judiciary playing a vital role in the enhancement and interpretation of environmental law. The Judiciary have played and will continue to play an important role in the development of legislative as well as in the institutional regimes for sustainable development. Promoting the goals of sustainable development is the judiciary's main role as well as dispute settlement. Judicial decisions give close attention to fundamental principles of law and justice which are vital to realize the aim of sustainable development. Added that, their judgements take steps precedents to courts within national and outside national boundaries. The Constitution of Bangladesh, 1972 does not bluntly take steps for the right to healthy environment as a fundamental right. It is state in Article 31 that “every citizen has the right to protection from “action detrimental to the life, liberty, body, reputation or property”, unless these are taken in accordance with law”. Article 32 states that “No person shall be deprived of life or personal liberty saves in accordance with law”.
